Small Introduction -:

Fssai department has made obligatory for all the food business operators in india to get an fssai license to institute their food business. The fssai logo plays a significant role by letting people know that the food product is licensed by the fssai and is hygienic to consume. It’s important for all the food business operators to obtain a 14-digit fssai license number and print it on all the food products they own. To defeat the adulteration in the food products and poor food products, fssai has made obligatory to get this license. Fssai scrutinizes for food license of all the food business operators on regular basis and performs stern actions on those businesses whose license has expired or does not have an active fssai license. There is a huge amount of customers trust involved in the safety and quality of food products. It serves to encourage innovation in various food products. It helps in the removal of various policies and support trade without negotiating customer safety. The FSSAI License brought into being by The Food Safety and Standards Authority of India established under the Food Safety and Standards Act, 2006 that integrates rules and regulations to ensure the food produced in various food production units are fit for human consumption. These production units can be manufacturers, storage units, transporters, retailers, marketers, distributors, petty food retailers etc. Ministry of Health & Family Welfare, Government of India, the administrative authority who supervises food related issues, implemented FSSAI License for food business operators.

As on date every FBO (Food Business Operator) or Individual engaged in the business of supply or manufacture or processing of food items are required to register with FSSAI License authority to run a business legally. The FSS Act, 2006 divided FSSAI license registration into the following 3 categories based on Activity, ➢ BASIC FSSAI REGISTRATION – This Registration required by very micro or pretty or small food businesses. WHICH HAVE yearly turnover upto Rs. 12 Lakh. THE Government Fees OF THis REGISTRATION IS Rs. 100/- only. The Validity of Registration is upto 5 years. The Food business owner required to fill Form A for registration ➢ STATE FSSAI LICENSE – This Registration required by macro or medium food businesse. The FBO whose yearly turnover exceeds Rs. 12 Lakh but upto Rs. 20 Introduction of fssai Types of FSSAI License crores. The Government Fees vary between Rs. 2000 to 5000 on the activity. The Validity of Registration is upto 5 years. The Food business owner required to fill Form B for registration ➢ CENTRAL FSSAI LICENSE – This Registration required by large food businesses. The FBO whose yearly turnover exceeds Rs. 20 crores. The Government Fees is Rs. 7500/- only. The Validity of Registration is upto 5 years. The Food business owner required to fill Form B for registration.

Who Required FSSAI License Registration

▪ Very Small Food Business Operators – Small retailer, salesman, Flower Product seller, Vendor, Thela, Desserts Shop, Juice Stall including Temporary or Fixed food Business place

▪ Dairy Units / Milk Cooling Units – Dairy preparation indicates trading with, handling, manufacturing, squeezing, putting away, conveyance and transportation of milk and milk items

▪ Vegetable Oil Treatment or processing Systems – Vegetable oil treatment means making vegetables to deliver vegetable oils by the method of dissolvable extraction/expeller and refining including oil expeller units

▪ Butchering House – Butchering implies a procedure of moving, dazzling, cutting, dressing, handling, putting away and transportation of live animals/poultry animals. Eg. Meat or Chicken or Mutton Shop

▪ Processing of Meat (Including Fish / Fish Products) – Meat preparing implies further handling of butchered animals/poultry feathered creatures into meat and meat items, bundling, putting away and shipping of meat / Fish and meat / Fish items

▪ Cold Storage – Cold storage means the activity in which packed or unpacked food items are refrigerated and further distributed to other refrigeration/freezing storerooms.

▪ Atmospheric Controlled Cold Storage – Atmospheric control Cold storage means the activity in which packed or unpacked food items are refrigerated in the Controlled environment and further distributed to other refrigeration / freezing storerooms & It’s is used for dry fruits or fruits or vegetable etc.

▪ Transporter – Milk Van/Truck, Milk Tanker, refrigerated Van or Truck, Food Truck etc.

▪ Distributor, Suppliers and retailers of food products – The person supply or distribute food products from the manufacturing units to suppliers or retailers to sold item to final consumer.

▪ Commercial Hotels Restaurant and Bars – The Hotel provide the facilities of lodging, meals etc. & Having Minimum 6 bedroom including 3 room with private Who Required FSSAI License Registration bathroom also a place where food & Drink are prepared & service to a consumer for consideration in the premises including take away or home delivery restaurant. Penalties associated with FSSAI

Along with the benefits, the FSSAI license also comes with its set of rules and guidelines. These requirements and instructions must be met with at all times. If any food enterprise is found to violate the set rules, then the business must face a penalty charge. The penalty charge in most cases is, in the form of a fee or monetary charge. The withdrawal of the license and keeping the business under a supervisor and routine inspection will be the penalty in case of a situation of grave violations or multiple accounts of rule-breaking. Most Importantly all eating houses and restaurants must mandatorily include the FSSAI license number on cash receipts from Oct 1, 2021. FSSAI took this decision in view of inconveniences encountered by the customer while lodging complaints Resent gide line from fssai…… The Food Safety and Standards Authority of India (FSSAI) through a circular dated 1 st October, 2021 has issued clarification on licensing/ registration of FBO’s manufacturing Indian sweets & snacks savouries. It has been clarified that –

▪ FBO’s who are manufacturing Indian sweets & snacks savouries products which are already licensed under proprietary food need not get their license modified under the new category 18 or any sub-categories under food category 18. ▪ FBO’s who are manufacturing Indian sweets & snacks savouries products may either obtain their license under proprietary food with nearest food category or license/registration under the new category 18 under their product formulations & ease of doing business. ▪ FBO’s who obtain their license/registration under category 18 shall not be bound to mention the food category or sub-categories of 18 on the label of such products. The said requirement is only in case of proprietary foods wherein the nearest category is to be declared on the product label. ▪ FBO’s who have already modified their licenses from proprietary food to food category 18 may approach FSSAI for the request to grant permission to use existing pre-printed packaging material with label of from proprietary food. The same shall be considered & granted on case-to-case basis as per the instructions / orders in vogue against the offending FBOs. It is needless to mention that the FBOs which intend to breach such a requirement may face severe legal repercussions. Further, this decision will likely help both FBOs and customers address the dispute regarding services with more clarity and promptness. FSSAI is mandating food businesses restaurants or other eating houses to add FSSAI numbers on bills generated against the services availed by the customers Food Businesses must add FSSAI number on bills from Oct 1, 2021. FSSAI envisages strengthening the grievance redressal mechanism by mandating eating houses to add FSSAI number on bills, cash memos, and other relevant receipts. FSSAI’s decision to add FSSAI number on bills comes with two-fold benefits. One, it will help end-users to promptly file the grievance against the offending FBO, and second, it would let the service providers undermine the hardship of identifying the source of the problem and expeditiously reconcile the matter.
