    Copyright Registration Overview –

    Copyright is type of intellectual property protection rights. It is govern by Copyright Act 1957. In general the definition of copyright is the exclusive and assignable legal right, given to the originator for a fixed number of years, to print, publish, perform, film, or record literary, artistic, or musical material.

    Copyright law gives creators of original material the exclusive right to further use and duplicate that material for a given amount of time, at which point the copyrighted item becomes public domain.

    However copyright registration is not mandatory but to save the creative work done by you for unauthorized use you are required to registered the same under the copyright act.The period of validity of a copyright is in general 60 years from its first publication, or delivery or broadcast to the public.

    Types Of Copyrights

    Literary Work

    The term ‘Literary works’ covers works that are in print or writing, irrespective of the quality of style of the work. Literary work refers not only to works of prose and poetry, but anything that would be under the ambit of ‘literature’. However, there will be no copyright if the work is merely a collection of words, the collection of which involved no literary skill. In India, a computer programme is treated as a “literary work” and is protected as such.

    Dramatic Work

    A dramatic work includes any piece for recitation, choreographic work or entertainment in dumb show, the scenic arrangement or acting form of which is fixed in writing or otherwise but does not include a cinematography film.

    Artistic Works

    Artistic work means a painting, a sculpture, a drawing (including a diagram, map, chart or plan), an engraving or a photograph, whether or not any such work possesses artistic quality, a work

    of architecture; and any other work of artistic craftsmanship. Any color scheme, getup, layout, or arrangement of any alphabets or features qualifies as an artistic work.

    Cinematography Work

    Cinematographic film means any work of visual recording on any medium produced through a process from which a moving image may be produced by any means and includes a sound recording accompanying such visual recording and “cinematographic” shall be construed as including any work produced by any process analogous to cinematography including video films.

    Musical Works

    Musical work means a work consisting of music and includes any graphical notation of such work but does not include any words or any action intended to be sung, spoken or performed with the music. A musical work need not be written to enjoy copyright protection.

    Sound Recordings

    Sound recording means a recording of sounds from which sounds may be produced regardless of the medium on which such recording is made or the method by which the sounds are produced. A phonogram and a CD-ROM are sound recordings

    Requirements For Copyright Registration

    Two copies of the work to be protected under copyright registration.

    Name, address and nationality of the applicant.

    Nature of the applicant’s interest in the work.

    Title of the work.

    Name, address and nationality of the creator or author of the work and if the author is deceased, the date of his death.

    Names, addresses and nationalities of the owners of the having rights in the copyright work and the extent of rights held by each owner, together with particulars of assignments and licenses, if any.

    Names, addresses and nationalities of other person, if any, authorized to assign or license the rights comprising the copyright.

    No -objection certificate from the Trademark Registry.

    The applications should be signed by the applicant or the advocate in whose favour a Power of Attorney has been executed. The Power of Attorney signed by the party and accepted by the advocate should also be enclosed.

    Year and name of the country of first publication of the work and name, address and nationality of the publisher

    Copyright subsists throughout India in the following classes of works:

    Original literary, dramatic, musical and artistic works;
    Cinematograph films; and
    Sound recordings.

    Any work which falls under any of the categories mentioned above and the work seeking to be copyrighted must be original; however, it is not necessary that the work should have some original thought or idea. The law is only concerned about the originality of the expression of thought.

    An author’s moral right as a right against distortion is available even after the expiry of the term of copyright.

    An assignment of copyright shall be valid only when it is in writing, signed by the assignor or by his duly authorized agent.

    After filing of the application, the department allots a diary number and waits for 30 days, also known as the waiting period, in case no objection is received from the public the examiner of the copyright examines the application. If the examiner comes up with any discrepancy, the same need to be resolved within 45 days. Therefore, it takes approx 2-4 months of time in the normal course in the registration of the copyright
